More than 14 days

No compensation due — airline gave sufficient notice. You may still be entitled to a refund or rerouting.

7 – 14 days notice

You qualify if the alternative flight departs 2+ hours early or arrives 4+ hours late vs the original schedule.

Full claim

Less than 7 days

Full compensation applies. Unless the airline offered a rerouting arriving within 1 hour of the original — you are owed the full amount.

The Airline's Excuse

"Extraordinary circumstances." The airline's favourite escape hatch.

Airlines use this phrase to reject 60%+ of claims. Here's what they won't tell you.

NOT Extraordinary

The European Court of Justice (Wallentin-Hermann v Alitalia, C-549/07) ruled routine technical faults are NOT extraordinary circumstances. You are owed compensation.

  • Routine maintenance or technical faults
  • Crew sickness or staff shortages
  • Airline staff strikes (most cases)
  • IT systems failure or operational issues

GENUINELY Extraordinary

The burden of proof is on the airline. They must prove circumstances were beyond their control AND they took all reasonable measures (Pešková v Travel Service, C-315/15).

  • Extreme weather (hurricane, volcanic ash)
  • Air traffic control strikes
  • Political instability or terrorism
  • Serious security threat at airport

Yes. Always. Article 7 of EC 261/2004 is non-waivable. Accepting a meal voucher, travel voucher, or rebooking at the airport does NOT waive your right to statutory cash compensation.
