EC261 vs UK261 — What's the Difference?

Understanding which regulation applies to your flight is crucial for claiming the correct compensation.

European Regulation EC261/2004

EC261/2004 is the European Union regulation that establishes common rules on compensation and assistance to passengers denied boarding, cancelled flights, or long delays. It applies to:

  • All flights departing from an EU/EEA airport
  • Flights arriving at an EU/EEA airport operated by an EU/EEA airline
  • Compensation amounts range from €250 to €600 depending on flight distance

UK Regulation UK261

After Brexit, the UK adopted its own version of the regulation, known as UK261. It mirrors EC261 in most respects but with key differences:

  • Applies to flights departing UK airports and UK-operated airlines
  • Compensation is paid in pounds sterling (£) not euros (€)
  • Maximum compensation is £520 for long-haul flights (vs €600)
  • Time limit for claims is 6 years (vs 2-6 years in EU countries)

Which Regulation Applies to You?

The key factor is your departure airport. If your flight departed from a UK airport (London Heathrow, Gatwick, Manchester, etc.), you fall under UK261. If it departed from an EU airport (Paris CDG, Frankfurt, Amsterdam, etc.), you fall under EC261.
