Flight Compensation

Emirates is one of the world's largest international airlines — and EC261 applies to all EU departures.

Emirates is the world's fourth-largest airline by scheduled revenue passenger-kilometers and the largest in the Middle East. Operating from its Dubai (DXB) hub, Emirates serves 150+ destinations with a fleet of wide-body aircraft. EC261 applies to all Emirates flights departing EU/EEA airports, making many long-haul claims from European departures eligible for compensation.

How Emirates Resists Claims

Emirates' initial rejection rate is moderate-to-high — approximately 50% of claims. They frequently cite 'extraordinary circumstances' for operational issues.

Common rejection wording includes 'technical issues,' 'weather conditions,' and 'connecting flight delays' — we verify these claims against actual data.

Emirates sometimes offers travel vouchers or miles instead of cash — these are not a legal substitute for EC261 compensation.

For EU-departing flights, Emirates is fully subject to EC261 — despite being a non-EU carrier.

Emirates' response time is typically 6–10 weeks. ADR escalation through the relevant EU authority is often necessary.

How We Handle Emirates Differently

We submit directly to Emirates' claims department in Dubai, citing the specific ECJ precedent that applies. For EU-departing flights, we emphasise Emirates' EC261 obligations. For rejected claims, we escalate to the relevant EU aviation authority (based on departure airport) — Emirates' compliance rate at ADR stage exceeds 70%.

02Common Emirates Disruptions

Disruption patterns specific to Emirates — and what each one means for your claim.

Flight delays (3hr+) — European departures

6–8% on European departure routes

EC261 applies to all Emirates flights departing EU/EEA airports. Delays on these routes are eligible for compensation if not due to extraordinary circumstances.

Long-haul delays from EU airports

For connecting flights where the first leg departs from an EU airport, EC261 applies to the entire journey if the first leg delay caused the missed connection.

Dubai hub connection delays

Moderate frequency on connecting itineraries
EU→DXB→Asia/Australia connections

If your Emirates flight from an EU airport was delayed and caused you to miss a connection at Dubai, arriving 3+ hours late at your final destination, you are eligible for compensation.

03Highest-Disruption Routes

Routes where Emirates passengers are statistically most likely to experience eligible delays. Based on CAA reports and FlightStats data.

04How We Handle Your Claim

1

You submit your flight details

Takes 2 minutes. We need your flight number, travel date, and what happened. No paperwork required from you upfront.

2

We build your Emirates-specific case

We submit a formal EC261 claim letter to Emirates' claims department in Dubai, citing the specific ECJ ruling that applies to your disruption. For EU-departing flights, we emphasise Emirates' EC261 obligations. If Emirates rejects or fails to respond within 8 weeks, we escalate to the relevant EU aviation authority — Emirates' compliance rate at ADR stage exceeds 70%.

3

Submission, escalation, and payment

Emirates payouts following ADR adjudication are typically processed within 7–10 business days. We always negotiate for bank transfer, not travel vouchers or miles.

Timeline: 6–10 weeks typical · 3–4 months via ADR

06Frequently Asked Questions

Real questions from passengers who flew with Emirates and claimed compensation.

Does EC261 apply to Emirates flights from Dubai?

No. EC261 only applies to Emirates flights departing EU/EEA airports. Flights departing Dubai (DXB) to the EU are not covered by EC261. However, flights departing from EU airports (LHR, CDG, FRA, AMS, etc.) are fully covered by EC261.

My Emirates flight departed from London and connected through Dubai — am I covered?

Yes. If your journey began at an EU airport (London in this case), EC261 applies to the entire journey on a single booking. If the first leg delay caused you to miss a connection and arrive 3+ hours late at your final destination, you are eligible for compensation.

Emirates rejected my claim citing 'connecting flight delay' — is that extraordinary?

No. If your Emirates flight from an EU airport was delayed due to the late arrival of the inbound aircraft (a knock-on delay), this is NOT extraordinary circumstances. Under ECJ precedent, knock-on delays are the airline's operational responsibility.

How long do I have to claim against Emirates?

The limitation period depends on the departure country. For German departures, it's 3 years. For French departures, 5 years. For UK departures, 6 years. Contact us with your flight details to confirm the applicable deadline.

Emirates offered me Skywards miles — should I accept?

Under EC261, you are entitled to cash compensation. Emirates Skywards miles are not a legal substitute. If you have not yet accepted the miles or signed a waiver of rights, you can still pursue the statutory cash amount.
